School Site Acquisition Charge

Background

On September 26, 2012, the Board of Education of School District No. 23 passed School District No. 23, Bylaw No. 15, to establish a School Site Acquisition Charge (SSAC). Under the Local Government Act, Sections 937.2 to 937.91, the District of West Kelowna is required to collect the SSAC on eligible residential development on behalf of the School District. The purpose of the charge is to provide for a portion of the funds required for the future acquisition of school sites that will be needed as a result of new residential development.

Implementation

The 60 day grace period to implement the charge ends on November 25, 2012. This means that all building permits and subdivision applications received on November 26, 2012 and thereafter may be required to pay the new SSAC depending on eligibility. The new SSAC levy ranges from $454 to $756 per unit depending on the type and density of residential development. Please contact the District of West Kelowna to determine if your residential subdivision or building permit will require you to pay School Site Acquisition Costs.

Transition Period

Local Government Act Sections 937.001 and 943 also provide for a 12 month transition period for applications that are currently in process with the municipality, subject to conditions.

For any person or company who is contemplating filing an application for a residential subdivision or building permit:

If your building permit or subdivision application is submitted and the applicable application fee has been paid prior to November 25, 2012, then the corresponding School Site Acquisition Charges may not apply to that application, if:

  • The building permit is issued on or before September 26, 2013; or,
  • The subdivision has received final approval on or before September 26, 2013.

For any person or company who currently has an application in process with the District for residential subdivision or building permit, including payment of the applicable application fee:

  • The subdivision has received final approval on or before September 26, 2013.
